13. 1 No Representative Actions.
You agree that any dispute popping up out of or related to JobandEdu’s Terms or our Services is between you and JobandEdu alone. Any such claim will be solved entirely through individual arbitration, rather than class ones, or any other kind of representative litigation.
13.2 Arbitration of Disputes.
You agree to first notify JobandEdu and attempt to resolve the claim informally by sending a written notice of your claim (“Notice”) to JobandEdu by email at email@example.com.
If the dispute cannot be resolved within forty-five (45) days after such Notice is received, then either party may escalate the dispute to binding arbitration in court.
The arbitrator, JobandEdu, and you will protect the confidentiality of any arbitration litigations, judgments and remedies. The duty includes, but not limited to, all information collected, prepared, and presented for related purposes. The arbitrator will have the right to impart relevant rules to safeguard confidentiality unless the law provides to the contrary. The confidentiality duty does not apply to the extent that disclosure is essential for the arbitration hearing on the merits, a preliminary remedy, or a judicial challenge to arbitration enforcement, or to the extent that disclosure is mandated by regulation or judicial decision.
You and JobandEdu agree that for any arbitration you initiate, you will pay the related fees.
Any claim arising out of or related to JobandEdu’s Terms and Conditions or our Services must be filed within 12 months after such claim arose. Otherwise, the claim is permanently barred, which means that you cannot claim.
14. Governing Regulation
JobandEdu’s Terms and Conditions follow the US’s Legal System.
